Tuesday, July 14, 2026, 11:30 a.m. (New York City time), 250 Broadway - 8th Floor - Hearing Room 1
Committee: Committee on Land Use
The Committee on Land Use, chaired by Council Member Kevin Riley, first voted on a package of land use items reported from its subcommittees, including three individual landmark designations (LU 91-93) and a series of zoning map and text amendments facilitating affordable and mixed-use housing developments in Brooklyn, Queens, the Bronx, and Staten Island, some approved with modifications (including removal of existing residential buildings from upzonings to address displacement concerns and removal of MIH Option Two). The committee also approved preconsidered items including a school siting in Staten Island, a UDAAP designation with a 40-year Article XI tax exemption at 511 West 171st Street, and the East Harlem/El Barrio Article XI amendment. All items passed by a vote of 13 in the affirmative, 0 in the negative, with no abstentions, as read by the committee clerk. The committee then held a hearing on Intro 833, sponsored by Council Member Sandy Nurse, which would remove 19th-century administrative code restrictions requiring 30-foot building setbacks along portions of Eastern Parkway in Brooklyn. Council Members Nurse and Mealy offered differing views, Mealy asking that her district's portion be excluded, and one member of the public testified before the hearing was closed.

7:23 While this portfolio spans
7:24 both my district and the
7:25 district represented by my
7:26 colleague, council membe
7:29 rincarnation. The residents who
7:30 call these buildings home
7:31 share the same expectation
7:32 that they have access t
7:35 ostable, well maintained,
7:36 affordable housing and
7:37 community resources that
7:38 strengthened the neighborhood,
7:41 their neighborhoods. This
7:41 application makes a targeted
7:42 amendment to a project that
7:45 the council originally
7:46 approved in 20 19
7:47 . It maintains the commitment
7:49 to approximately 36 went into
7:51 units while updating the
7:52 project to include three
7:54 community facility spaces
7:55 instead of two commercial
7:56 spaces and one community
8:00 facility space. That is a
8:01 thoughtful adjustment tha
8:02 tbetter reflects the needs of
8:04 the surrounding community and
8:05 creates additional
8:06 opportunities for services
8:09 that residents can access
8:10 close to their homes for the
8:12 families living at these
8:13 addresses. This is
8:14 . About more than a technical
8:16 amendment. It's about
8:17 preserving affordable housing
8:18 supporting the continued
8:20 rehabilitation and stewardship
8:21 of these buildings and
8:23 ensuring that residents have
8:25 access to spaces that can
8:26 provide meaningful community
8:30 benefits. I appreciate,
8:30 appreciate the collaborations
8:32 between our council districts.
8:34 The applicants and all of the
8:36 stakeholders who have worked
8:37 to move this project forward
8:41 when we invested in preserving
8:42 affordable homes and
8:42 strengthening the services
8:44 available to residents. We are
8:46 . Investing in the long term
8:46 stability of our neighborhoods
8:49 for these reasons, I
8:50 respectfully urge my
8:52 colleagues on this committee
8:53 to support this application.
8:54 Thank you, chair

12:03 Thank you. Now we move on to
12:05 our here regarding intro t
12:07 onumber 8 33, which as I
12:09 mentioned is sponsored by
12:10 Council Member Sandy Nurse and
12:13 seeks to address outdated
12:14 restrictions on building
12:16 locations along portions of
12:17 eastern parkway in brooklyn
12:20 too late today, a portions of
12:22 eastern paray ekwastern
12:23 parkway extension in brooklyn
12:25 between ralph avenue to the
12:26 west and bush avenue to the
12:29 east certain development
12:31 restrictions or sides in the
12:32 city's administrative cold
12:35 such that buildings and
12:35 structures must be set back
12:37 from the street line at the
12:39 distance of 30 feet. The
12:41 origins of these restrictions
12:42 date from the nineteenth
12:45 century where parkway planners
12:46 envisioned green way along
12:48 either side of the right away.
12:51 However, in the decades since
12:53 is enactment now compliant
12:55 development and shifting I and
12:57 priorities have diluted the
12:59 rationale for these rules
13:00 along much of the role ways
13:03 lymph and show 8 33, proposes
13:05 a target amendment of the
13:07 season, ministry of coal t
13:09 oremove these restrictions
13:11 ,except along maybe the
13:12 portions of the street where
13:14 established development
13:15 patterns reflect the original
13:18 intent. I would like to know
13:19 that the committee has
13:20 received written testimony on
13:21 behalf of the administratio
13:22 nfrom the department of City
13:24 planning that supports this
13:26 bill and we will answer that
13:27 testimony into record at
13:31 today's hearing, the council
13:32 looks forward to hearing
13:32 feedback from the public
13:34 relating to the existing
13:36 restrictions and the proposed
13:37 amendment at this time before
13:38 we opened it up for the public
13:40 testimony. I would like to not
13:41 recognize my colleague
13:43 councilmember Sandy narcs for
13:47 our remarks. Thank you, chair
13:47 and thank you for hearing this
13:49 . I just want to express my
13:51 full support for this and just
13:52 give a just a minute of
13:55 context. This proposal came
13:56 about because of a the
14:00 property on the corner of
14:02 bushwick and eastern parkway
14:04 is being turned into hundreds
14:07 of units of affordable housing
14:08 , and it didn't go through
14:10 ,you lurk. But the developer
14:12 and the dull fun have agreed
14:14 to build a community
14:18 recreation center for the
14:19 community as part of this and
14:21 we really need to amend this.
14:24 Do this zoning text amendment
14:26 so that we can move forward
14:27 with the project. Um, I
14:31 understand that there might
14:32 you know this the way this is
14:35 written, includes other
14:37 council districts, that's fin
14:38 e, however, if there is
14:42 opposition. You know, I would
14:43 love to remove those districts
14:45 from this. So we can make this
14:48 happen, you know this should
14:49 have really been passed last
14:51 year. It's this is very long
14:52 delayed, so I would like t
14:54 osee this movie forward. I'm
14:55 glad the administrative is
14:58 supportive and thank you,
14:58 chair for moving this forward.
15:00 This is not going to impact
15:02 property taxes. This has been
15:04 confirmed by other agencies
15:07 and so we want to see the
15:08 housing gets built. This is
15:10 affordable housing for folks
15:11 in our community and it will
15:14 be lead to a community center
15:16 that is much needed in that
